DECISION & ORDER ON MOTION

Motion by the respondents to dismiss an appeal from an order of the Supreme Court, Queens County, entered May 20, 2014, on the ground that the appendix is inadequate or, in the alternative, to direct the appellant to serve and file a supplemental appendix and to enlarge their time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to direct the appellant to serve and file a supplemental appendix is granted and on or before September 17, 2015, the appellant shall serve and file a supplemental appendix containing the following material:

(1) the notice of motion for the motion that was determined by the order entered May 20, 2014, and affirmation of Shane M. Biffar and annexed exhibits filed in support of the motion;

(2) notice of cross motion for the cross motion that was determined by the order entered May 20, 2014, and affirmation of Marina V. Moreno and annexed exhibits filed in support of the cross motion and in opposition to the motion;

(3) reply affirmation of Shane M. Biffar; and

(4) reply affirmation in support of the cross motion and in opposition to the motion; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondents' time to serve and file a brief is granted, the respondents' time to serve and file a brief is enlarged until October 19, 2015, and the respondents' brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
