| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to strike the respondent's appendix and brief on appeals from an order of the Supreme Court, Suffolk County, dated June 17, 2013, and a judgment of the same court entered August 12, 2013, to impose a sanction upon the respondent, and to enlarge the time to serve and file a reply brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike the respondent's appendix and brief is granted, and on or before September 21, 2015, the respondent may serve and file a replacement brief and appendix that does not refer to or contain matter dehors the record; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a reply brief is granted, and the reply brief, if any, must be served and filed on or before October 21, 2015; and it is further,
ORDERED that the motion is otherwise denied.
