It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that tenant-appellant's motion is granted only to the extent of enlarging his time to perfect his appeal on condition that tenant-appellant perfect his appeal by no later than the December 2015 term - the filing deadline is October 14, 2015. In the event of tenant-appellant's failure to comply with the foregoing condition, landlord-respondent may move on five days notice for an order dismissing the appeal.
