| DECISION & ORDER ON MOTION |
Motion by Smithtown Central School District for leave to appeal to this Court from an order to show cause of the Supreme Court, Suffolk County, dated August 20, 2015, and to stay enforcement of the order to show cause, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is granted; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of the order to show cause dated August 20, 2015, is granted to the extent that enforcement of the temporary restraining order contained in the order to show cause is stayed pending hearing and determination of the appeal, or determination by the Supreme Court, Suffolk County, of the underlying motion, and that branch of the motion is otherwise denied.
