Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of Supreme Court, Monroe County, rendered February 9, 2015,
Now, upon reading and filing the affidavit of Amanda Hunt sworn to August 11, 2015, the notice of motion with proof of service thereof, the answering statement of Charles A. Schiano, Jr., Esq. dated August 31, 2015, the statement of Daniel Gross, Esq. dated August 31, 2015, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that Charles A. Schiano, Jr., Esq. is hereby directed to serve the notice of appeal dated February 11, 2015 in accordance with CPL 460.10 on or before October 9, 2015, and
It is further ORDERED that if said notice of appeal is timely served, the notice, which inaccurately lists the judgment rendered date as February 10, 2015, shall be treated as valid as to the judgment rendered February 9, 2015, pursuant to CPL 460.10(6).
