On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated August 10, 2015, in the above-entitled action is recalled and vacated and the following decision and order on motion is substituted therefor:
Motion by Julio Estrada pursuant to CPL 460.30 for an extension of time to take appeals from a judgment of the Supreme Court, Queens County, rendered February 2, 2015, and a resentence of the same court, imposed February 4, 2015.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the moving papers are deemed to constitute a timely notice of appeal.
