The People, etc., respondent,

v Sabas Martinez, appellant.

(Ind. No. 450/11)

DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to prosecute an appeal from a purported judgment of the County Court, Suffolk County, rendered April 2, 2015, as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the appeal is dismissed on the ground that no judgment rendered April 2, 2015, exists in connection with the above-entitled action; and it is further,

ORDERED that the motion is denied as academic.

DILLON, J.P., DICKERSON, COHEN and DUFFY, JJ., concur.
