Motion by appellant for leave to appeal to the Appellate Division from a decision and order on motion of this court dated July 13, 2015, which dismissed an appeal from a final judgment of the City Court of New Rochelle, Westchester County, entered March 11, 2015.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that appellant's motion is denied as moot; and it is further,
ORDERED, on the court's own motion, that this court's decision and order on motion dated July 13, 2015 is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by respondent to dismiss an appeal from a final judgment of the City Court of New Rochelle, Westchester County, entered March 11, 2015, and for costs and sanctions.
