| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to reconstruct the court file on an appeal from a judgment of the Supreme Court, Kings County, entered April 8, 2014. Application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief to November 20, 2015.
Upon the papers filed in support of the motion and the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied without prejudice to renewal, on or before October 5, 2015, upon proper papers, including an affirmation identifying with specificity the documents missing from the original record; and it is further,
ORDERED that the application is granted to the extent that the respondent's time to serve and file a brief is enlarged until November 5, 2015, the respondent's brief, if any, must be served and filed on or before that date, and the application is otherwise denied.
