| DECISION & ORDER ON MOTION |
Motion by the respondent to strike footnote 3 on page 26 of the appellant's brief on an appeal from a judgment of the Supreme Court, Kings County, rendered October 22, 2012.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, footnote 3 on page 26 of the appellant's brief is stricken, and on or before October 15, 2015, the appellant shall delete the stricken material from the copies of the briefs filed with the Clerk of the Court or serve and file a replacement brief that does not contain the stricken material; and it is further,
ORDERED that on the Court's own motion, the appellant's time to serve and file a reply brief is enlarged until October 26 2015, and the reply brief must be served and filed on or before that date.
