Motion by the appellant Patrick Williams on an appeal from a judgment of the County Court, Nassau County, rendered September 30, 2014, (1) to continue a stay of execution of the judgment which was granted by decision and order on motion of this Court dated October 2, 2014, and continued by decisions and orders on motions of this Court dated March 5, 2015, as amended June 26, 2015, and dated July 21, 2015, and (2) to consolidate the appeal with appeals from two judgments of the same court, also rendered September 30, 2014, taken by his co-defendants, Neville Mullings and Roger Corbin, respectively.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is to continue the stay of execution of the judgment is granted, and the stay of execution of the judgment granted by the decision and order on motion of this Court dated October 2, 2014, and continued by the decisions and orders on motions of this Court dated March 5, 2015, as amended June 26, 2015, and dated July 21, 2015, is extended pending determination of the appeal from that judgment on condition that the appellant Patrick Williams perfects his appeal by November 30, 2015, and on the same conditions imposed by the decision and order on motion of this Court dated October 2, 2014; and it is further,
ORDERED that this stay shall terminate and be of no further effect, and the appellant Patrick Williams shall thereafter surrender to serve the sentence imposed, unless his appeal is perfected on or before November 30, 2015; and it is further,
ORDERED that upon the termination of this stay as provided above, this order shall constitute authorization to any peace officer to arrest and deliver the appellant Patrick Williams to the sentencing court to begin the execution of sentence; and it is further,
ORDERED that counsel for the appellant Patrick Williams shall serve a copy of this order, by mail, on the clerk of the County Court, Nassau County; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied without prejudice to renew upon a joint motion made by all three appellants or separate motions made by each appellant.
