Appeal from an order of the Civil Court of the City of New York, Kings County, entered August 30, 2011. The order, insofar as appealed from, denied appellants' motion to restore the action to the trial calendar.

ORDERED that the appeal is dismissed as academic, as by decision and order on motion dated August 26, 2015, this court recalled and vacated its prior decision and order denying appellants' motion for summary judgment and substituted therefor a decision and order granting appellants' motion (48 Misc 3d 142[A], 2015 NY Slip Op 51271[U]).
