| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to post an undertaking in the sum of $19,000 as a condition of obtaining a stay of enforcement of an order of the Supreme Court, Nassau County, entered March 9, 2015, pending hearing and determination of an appeal therefrom.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and enforcement of the order entered March 9, 2015, is stayed pending hearing and determination of an appeal therefrom on condition that on or before October 19, 2015, the appellant deposit the sum of $19,000 with the Clerk of the Supreme Court, Nassau County, and file proof of such deposit with this Court; and it is further,
ORDERED that in the event that the appellant fails to deposit the sum of $19,000 with the Clerk of the Supreme Court, Nassau County, and file proof of such deposit with this Court, the Court may vacate the stay, without further notice, or the respondent may move to vacate the stay on three days notice.
