| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to recall and vacate a decision and order on motion of this Court dated August 4, 2015, which dismissed an appeal from an order of the Family Court, Westchester County, dated June 9, 2015, on the ground that no appeal lies as of right from an order entered upon the consent of an appealing party, to reinstate the appeal, for poor person relief, and for the assignment of counsel.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied, without prejudice to seeking appropriate relief in the Family Court, Westchester County.
HALL, J.P., SGROI, COHEN and MALTESE, JJ., concur.
