DECISION & ORDER ON MOTION

Motion by the respondent to strike the appellant's brief on an appeal from a judgment of the Supreme Court, Queens County, rendered July 19, 2010, on the ground that the appellant has failed to file the complete transcripts of the proceedings. Separate motion by the appellant pro se to extend his time to renew his prior motion to relieve retained counsel, for poor person relief and for the assignment of counsel.

Upon the papers filed in support of the respondent's motion and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the appellant's motion and the papers filed in opposition thereto, it is

ORDERED that the respondent's motion is granted to the extent that on or before January 14, 2016, the appellant shall either (1) serve and file all remaining transcripts of the proceedings, (2) move to substitute retained counsel, or (3) move to relieve retained counsel, for poor person relief and for the assignment of counsel and the motion is otherwise denied; and it is further,

ORDERED that the appellant's motion is granted to the extent set forth above and is otherwise denied.
