It is Ordered that the tenant-respondent's motion is granted on condition that the tenant-respondent 1) serves and files his brief by the December 2015 term - the filing deadline for the respondent's brief of which is November 5, 2015, and 2) pays landlord the sum of $2,364.00 ($788 x 3) by October 30, 2015, and 3) continues to pay to the landlord accruing use and occupancy, at the rate of $788.00 per month on or before each subsequent rental due date during the pendency of the appeal, without prejudice.
