| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from an order of the Court of Claims, dated January 5, 2015, to vacate a stay of all proceedings in the above-entitled action, which was granted by decision and order on motion of this Court dated June 15, 2015. Application by the appellant to withdraw the appeal.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the appeal is deemed withdrawn, without costs or disbursements; and it is further,
ORDERED that the motion is granted and the stay contained in the decision and order on motion of this Court dated June 15, 2015, is vacated forthwith.
