Motion by plaintiff to deem properly filed a notice of appeal from an order of the District Court of Suffolk County, First District, entered March 27, 2015. Cross motion by defendant to dismiss the purported appeal.
Upon the papers filed in support of the motion and cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied (see People v Duggan, 69 NY2d 931 [1987]; People v Yates, 165 Misc 2d 375, 376 [1995]); and it is further,
ORDERED that the cross motion is granted and the purported appeal is dismissed.
