Motion to dismiss appeal pursuant to 22 NYCRR 500.22 (b) (4).

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motion for permission to proceed as a poor person and to proceed upon the original file of the Workers' Compensation Board is denied, without costs, and without prejudice to renewal in the event claimant moves for, and obtains, an extension of time to perfect the appeal in accordance with section 800.12 of this Court's Rules of Practice, and it is further

ORDERED that the motion to dismiss the appeal pursuant to 22 NYCRR 500.22 (b) (4) is denied, without costs.
