2015-09057, 2015-09249 Canz Suffolk One, Inc., respondent, v Cannon Rock Group, LLC, et al., appellants. (Index No. 25059/14)
| DECISION & ORDER ON MOTION |
Motion by the appellants on appeals from two orders of the Supreme Court, Suffolk County, dated January 26, 2015, and April 27, 2015, respectively, to stay enforcement of the order dated January 26, 2015, pending hearing and determination of the appeals, and to consolidate the appeals.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, the appeal from the order dated April 27, 2015, is dismissed, without costs or disbursements, on the ground that no appeal lies from an order denying reargument; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of the order dated January 26, 2015, is denied; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied as academic.
DILLON, J.P., CHAMBERS, AUSTIN and SGROI, JJ., concur.
