DECISION & ORDER ON MOTION

Motion by David Kramer, inter alia, for leave to appeal to this Court from an order of the Supreme Court, Nassau County, dated October 16, 2015, and a decision of the same court also dated October 16, 2015, and to stay enforcement of the order as well as stated portions of the decision, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal from the order is denied as unnecessary as the order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that David Kramer shall serve and file a notice of appeal from the order in accordance with CPLR 5514(a); and it is further,

ORDERED that the motion is otherwise denied.
