The People, etc., respondent,

v Anthony Grigoroff, appellant.

(Ind. No. 23/09)

DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, for a change of venue of the trial of Putnam County Indictment No. 23-09 from Putnam County to another county.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for a change of venue is denied without prejudice to renewal upon a demonstration that there has arisen during voir dire proceedings reasonable cause to believe that a fair and impartial trial cannot be had in Putnam County (see CPL 230.20[2]; People v Boudin, 95 AD2d 463; People v Boudin, 97 AD2d 84); and it is further,

ORDERED that the motion is otherwise denied.

CHAMBERS, J.P., HALL, COHEN and MILLER, JJ., concur.
