Petitioner having moved to consolidate the appeals taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Oneida on May 19, 2015 (appeal No. 1), and August 3, 2015 (appeal No. 2), and respondent-respondent-appellant having cross-moved to dismiss petitioner's appeals for failure to timely perfect the appeals,
Now, upon reading and filing the affirmations of Mark T. Whitford, Jr., Esq., dated October 19, 2015, and November 6, 2015, the affirmation of Ralph W. Fusco, Esq., dated October 26, 2015, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that petitioner's motion insofar as it seeks to consolidate the appeals is granted, and the appeals from the orders entered May 19, 2015, and August 3, 2015, are hereby consolidated for the purposes of perfecting and arguing the appeals, and
It is further ORDERED that respondent-respondent-appellant's cross motion insofar as it seeks to dismiss the appeals for failure to timely perfect the appeals is granted and the appeals are dismissed without further order unless the appeals are perfected on or before January 15, 2016.
