It is Ordered that the motion of the plaintiff-respondent to dismiss the appeal and release the funds deposited with the Commissioner of Finance is granted, unless the defendant-appellant perfects his appeal by no later than the March 2016 term, the filing deadline for which is January 12, 2016. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move on five days notice for an order dismissing the appeal.
