| DECISION & ORDER ON MOTION |
Motion by 485 Ocean Realty, LLC, and JMM Management, LLC, to stay the trial in the above-entitled action, pending hearing and determination of an appeal and a cross appeal from an order of the Supreme Court, Kings County, dated May 6, 2015. Separate motion by Midtown Elevator Co., Inc., to stay all proceedings in the above-entitled action, including the trial, pending hearing and determination of the appeal and cross appeal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion by 485 Ocean Realty, LLC, and JMM Management, LLC, and the branch of the motion by Midtown Elevator Co., Inc., which is to stay the trial are granted, and the trial in the above-entitled action is stayed pending hearing and determination of the appeal and cross appeal; and it is further,
ORDERED that the motion by Midtown Elevator Co., Inc., is otherwise denied.
