Petitioner Ross John having moved for an extension of time to file and serve a brief on the appeal taken herein from a judgment (denominated order) of the Supreme Court entered in the Office of the Clerk of the County of Cattaraugus on July 15, 2014, and having moved to put the appeal over term,

Now, upon reading and filing the affidavit of Maura C. Seibold, Esq., sworn to November 13, 2015, the notice of motion with proof of service thereof, and the affirmation of Joel J. Terragnoli, Esq., dated November 20, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted insofar as petitioner Ross John seeks an extension of time to file and serve a respondent's brief on the condition that the brief is filed and served on or before January 19, 2016, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that reply briefs to petitioner Ross John's brief, if any, shall be filed and served on or before February 2, 2016, and

It is further ORDERED that the motion is granted insofar as it seeks to put the appeal over term and the appeal is removed from the day calendar of this Court for December 7, 2015, and is added to the term of this Court commencing April 4, 2016.
