In the Matter of Jerald Miller, petitioner-respondent,

v New York State Division of Human Rights,

respondent-appellant, et al., respondents.

(Index No. 10771/12)

DECISION & ORDER ON MOTION

Motion by the petitioner-respondent, inter alia, for leave to reargue an appeal from an order of the Supreme Court, Kings County, dated January 13, 2014, which was determined by decision and order of this Court dated June 17, 2015.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for reargument of the appeal is dismissed on the ground that the petitioner-respondent does not have standing to seek this relief as he did not file a brief on the appeal; and it is further,

ORDERED that the motion is otherwise denied.

DILLON, J.P., DICKERSON, ROMAN and LASALLE, JJ., concur.
