It is Ordered that the motion of the landlord-respondent for an order vacating the stay and dismissing the appeal is granted. That portion of the landlord-respondent's motion for an order releasing the funds on deposit with the Commissioner of Finance is denied without prejudice, to the landlord- respondent seeking relief in Civil Court.
