DECISION & ORDER ON MOTION

Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from an order of the Supreme Court, Queens County, dated March 3, 2014, and for the assignment of new counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to the appellant's seeking leave to serve and file a pro se supplemental brief after assigned counsel files a brief on his behalf; and it is further,

ORDERED that assigned counsel shall serve and file a brief on the appellant's behalf on or before February 16, 2015.
