| DECISION & ORDER ON MOTION . |
Motion by the appellant to stay enforcement of an order of the Family Court, Queens County, dated November 9, 2015, pending hearing and determination of an appeal therefrom, and, in effect, pursuant to CPLR 5520(a), to deem the notice of appeal, which was timely filed and served upon the petitioner-respondent, to be timely served upon the respondent-respondent.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the order dated November 9, 2015, is denied; and it is further,
ORDERED that the branch of the motion which is, in effect, pursuant to CPLR 5520(a), to deem the notice of appeal, which was timely filed and served upon the petitioner-respondent, to be timely served upon the respondent-respondent is granted.
