Respondent-appellant having moved to vacate the dismissal of the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on May 29, 2014 (CAF 14-00965), and to consolidate that appeal with the appeal taken from the order of the Family Court, Erie County, entered June 16, 2015 (CAF 15-01112),
Now, upon reading and filing the affirmation of Evelyne A. O'Sullivan, Esq., dated November 25, 2015, the notice of motion with proof of service thereof, and the affirmation of Charles D. Halvorsen, Esq., dated November 30, 2015, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate the dismissal of the appeal taken from the order entered May 29, 2014, is granted on condition that the appeal is perfected on or before February 15, 2016, and
It is further ORDERED that the motion insofar as it seeks to consolidate the appeals is denied.
