DECISION & ORDER ON MOTION
| The People of the State of New York, Respondent, v Ryan Krosecky, Appellant. |
Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered October 5, 2015, as a poor person, and for the assignment of counsel. The notice of appeal was filed on November 6, 2015.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that the parties show cause before this court why the above-entitled appeal should or should not be dismissed as untimely and appellant has not sought leave to file a late notice of appeal (see CPL 460.10, 460.30), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before January 22, 2016; and it is further,
ORDERED that appellant's motion is held in abeyance in the interim; and it is further,
ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties' attorneys by regular mail.
