| DECISION & ORDER ON MOTION |
Motion by Geoffrey Chanin, counsel assigned to prosecute an appeal from a judgment of the County Court, Orange County, rendered June 6, 2014, to be relieved of the assignment on the ground that there are no nonfrivolous issues to be raised on the appeal.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied without prejudice to filing a brief in accordance with Anders v California, (386 US 738) and 22 NYCRR 670.12 (g), in the form attached to the motion papers on or before January 20, 2016; and it is further,
ORDERED that assigned counsel shall also serve the brief on the District Attorney and the appellant, and serve the appellant with a letter pursuant 22 NYCRR 670.12(g)(2) on or before January 20, 2016.
