| DECISION & ORDER ON MOTION |
Motion by Jay Gusler to extend the time to file a notice of appeal from an order and judgment (one paper) of the Supreme Court, Nasaau County, entered April 8, 2015, which was timely served. Cross motion by City of Long Beach, Jack Schnirman, and Corey Klein to dismiss the appeal for failure to timely perfect.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is denied as academic; and it is further,
ORDERED that on the Court's own motion, the appeal by City of Long Beach, Jack Schnirman, and Corey Klein is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules of this Court (see 22 NYCRR 670.8[e]).
