Motion by McDonough and McDonough, LLP, to extend its time to comply with a decision and order on motion of this Court dated October 30, 2015, which, upon granting its motion for leave to withdraw as counsel for the appellant on an appeal from an order of the Supreme Court, Westchester County, entered February 4, 2015, directed it to serve its client by one of the methods specified in CPLR 2103(c), with a copy of the decision and order on motion dated October 30, 2015, and file proof of such service with the Clerk of this Court on or before November 13, 2015. Cross motion by the appellant, inter alia, to recall and vacate the decision and order on motion dated October 30, 2015.
Upon the papers filed in support of the motion and the cross motion, and the papers filed opposition thereto, it is
ORDERED that the motion is granted, and the decision and order on motion dated October 30, 2015, is deemed timely served upon the appellant; and it is further,
ORDERED that the cross motion is denied.
