DECISION & ORDER ON MOTION

Motion by Jane Lockley for leave to appeal to this Court from a judgment of the Supreme Court, Kings County, dated October 21, 2015, to stay certain proceedings in Housing Court, pending hearing and determination of the appeal, and for poor person relief, including leave to prosecute the appeal on the original papers.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as the judgment is appealable as of right (see CPLR 5701); and it is further,

ORDERED that Jane Lockley may serve and file a notice of appeal from the judgment dated October 21, 2015, in accordance with CPLR 5514(a); and it is further,

ORDERED that the motion is otherwise denied without prejudice to renew after the notice of appeal has been filed.
