| DECISION & ORDER ON MOTION |
Motion by the appellant to strike Point II and stated portions of Point III and Point IV of the brief of the respondent A & L Properties, Inc., on an appeal from an order of the Supreme Court, Westchester County, dated March 2, 2015, on the ground that those portions of the brief improperly raise arguments for the first time on appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.
