ORDERED that the branch of the motion which is for leave to appeal to this Court from so much of the order dated August 11, 2015, as denied a motion pursuant to CPL 440.46 is denied as unnecessary (see CPL 440.46[3]; L 2004, ch 738, § 23); and it is further,

ORDERED that the motion is otherwise denied.
