DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Nassau County, entered September 24, 2013, on the ground that the judgment was entered upon the appellant's default. By decision and order on motion dated June 5, 2014, the motion was

held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission of the appeal. The appeal has not been perfected.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion the appeal is dismissed, without costs or disbursements, for failure to perfect in accordance with the rules of this Court (see 22 NYCRR 670.8[e]); and it is further,

ORDERED that so much of the decision and order on motion of this Court dated June 5, 2014, as referred the motion to dismiss the appeal to the panel of Justices hearing the appeal is recalled and vacated, and the motion is denied as academic.
