| DECISION & ORDER ON MOTION |
Motion by the defendant-appellant pro se on appeals from an order of the Supreme Court, Rockland County, dated November 13, 2015, in effect, to deem her notice of appeal timely served and filed, to stay the sale of the marital residence and distribution of the sale proceeds, pending hearing and determination of the appeals, for leave to prosecute her appeal as a poor person, and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, to deem the defendant-appellant's notice of appeal timely served and filed is denied as unnecessary (see CPLR 5513); and it is further,
ORDERED that the motion is otherwise denied.
