Application to withdraw a proceeding pursuant to CPLR article 78 in the nature of mandamus to compel Lenora Gerald, a Justice of the Supreme Court, Queens County, to issue a final judgment of divorce in an action entitled Cunningham v Brutman, pending under Index No. 31704/10.
Upon the stipulation of the respective parties to the appeal dated February 1, 2016, it is
ORDERED that the application is granted and the proceeding is deemed withdrawn, without costs or disbursements.
