DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by Mark Alan Kovler for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Kovler was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on March 7, 1984, under the name Mark Allan Kovler. By decision and order on application of this Court dated February 19, 2002, the Grievance Committee for the Ninth Judicial District was granted leave to institute and prosecute a disciplinary proceeding against Mr. Kovler, and the issues were referred to the Honorable Vincent Pizzuto, as Special Referee, to hear and report. By opinion and order of this Court dated July 8, 2002, Mr. Kovler was disbarred upon his resignation and his name was stricken from the roll of attorneys and counselors-at-law, effective immediately.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on Mark Allan Kovler's current character and general fitness to practice law, including but not limited to, the outcome of the malpractice action filed against him in federal court by Bettijaine Gentry and Gentry Promotions, Inc.
