DECISION & ORDER ON MOTION

Motion by the appellant to stay all proceedings in an action entitled People v Li, pending in the District Court, Nassau County, under Docket No. 23862/14, and to stay enforcement of two orders of the District Court, Nassau County, dated July 28, 2015, and November 23, 2015, respectively, pending hearing and determination of an appeal from a judgment of the Supreme Court, Nassau County, entered November 10, 2015, in the above-entitled proceeding.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and all proceedings in the action entitled People v Li, pending in the District Court, Nassau County, under Docket No. 23862/14, and enforcement of the orders of the District Court, Nassau County, dated July 28, 2015, and November 23, 2015, are stayed pending hearing and determination of the appeal from the judgment entered November 10, 2015, on condition that the appeal is perfected on or before March 29, 2016; and it is further,

ORDERED that in the event the appeal is not perfected on or before March 29, 2016, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
