Appellant having moved for permission to proceed as a poor person and assignment of counsel for the appeal taken from an order of Onondaga County Court, dated November 25, 2014 (KA 15-00248), and for other relief,
Now, upon reading and filing the affirmation of Philip Rothschild, Esq. dated January 28, 2016, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks poor person relief and assignment of counsel is denied with leave to renew upon the filing and serving of a motion, which contains an affidavit from defendant establishing his indigency (see 22 NYCRR 1000.14 [a] [1]), and
It is further ORDERED that the motion is otherwise dismissed as premature.
