| DECISION & ORDER ON MOTION |
Motion by the defendants for leave to appeal to this Court from so much of an order of the Supreme Court, Suffolk County, dated October 28, 2015, as directed the defendant Rhona Silver to submit to a psychiatric examination, and to stay all proceedings to punish Ms. Silver for contempt for failure to appear for the psychiatric examination or for failure to comply with the order dated October 28, 2015, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that pending hearing and determination of the appeal enforcement of so much of the order dated October 28, 2015, as directed the defendant Rhona Silver to submit to a psychiatric examination is stayed and all proceedings to punish Ms. Silver for contempt for failure to appear for the psychiatric examination or for failure to comply with the order dated October 28, 2015, are stayed.
