Proceeding pursuant to CPLR article 78 in the nature of prohibition, inter alia, to prohibit the sale of the petitioner's real property in an action entitled Southwest Capital Investments, LLC & Show Homes, Inc., v Reqiste, pending in the Supreme Court, Kings County, under Index No. 431/05, before the respondent Peter Paul Sweeney, a Justice of the Supreme Court, Kings County.
ORDERED that on the Court's own motion, the petition is dismissed, without costs or disbursements.
The petitioner failed to serve a named party, the respondent Peter Paul Sweeney (see CPLR 403[c[).
