Appellants having moved, pursuant to CPLR 5518, for a preliminary injunction enjoining construction and any work on the site of the Lago Resort and Casino in the Town of Tyre, New York, pending the hearing and determination of the appeal taken herein from a order and judgment of the Supreme Court entered in the Office of the Clerk of the County of Seneca on February 1, 2016,

It is hereby ORDERED that the motion insofar as it seeks preliminary injunction is denied, and

It is further ORDERED that if appellants perfect the appeal on or before March 25, 2016, the appeal shall be added to the Court's calendar for the term commencing May 16, 2016, and

It is further ORDERED that if the appeal is perfected on or before March 25, 2016, respondents' briefs shall be filed on or before April 19, 2016, and reply briefs, if any, shall be filed on or before April 29, 2016.
