DECISION & ORDER ON MOTION

Motion by Dean A. Reskakis, inter alia, for leave to reargue a disciplinary proceeding against him, which was determined by an opinion and order on this Court dated October 14, 2015, and, upon reargument, to modify the sanction imposed. Mr. Reskakis was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 1, 2002. By decision and order on motion of this Court dated January 31, 2012, this Court suspended Mr. Reskakis in the interim pursuant to Judiciary Law § 90(4)(d), based on his conviction of a serious crime, that is, conspiracy to commit wire and bank fraud, and directed him to apprise the Court upon being sentenced. By letter dated March 14, 2014, Mr. Reskakis advised the Court that he had been sentenced the day before. By decision and order on motion dated June 9, 2014, the Court, on its own motion, authorized the Grievance Committee to institute and prosecute a disciplinary proceeding against Mr. Reskakis, and referred the issues raised to the Honorable Abraham Gerges, as Special Referee, to hear and report. By opinion and order of this Court dated October 14, 2015, the respondent was disbarred, effective immediately.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied.
