| DECISION & ORDER ON MOTION |
Appeal by Michael Rizzo from an order of the Supreme Court, Nassau County, dated June 2, 2015. By scheduling order dated January 4, 2016, the appellant's time to perfect the appeals was enlarged until January 18, 2016. The appellant has failed to perfect the appeal.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.4[a][2],[4]) and prior order of the Court.
