| DECISION & ORDER ON MOTION |
Motion by the respondents to dismiss an appeal from an order of the Supreme Court, Richmond County, dated October 8, 2015, for failure to timely perfect.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied on condition that the appellant perfect the appeal on or before April 15, 2015; and it is further,
ORDERED that in the event the appeal is not perfected on or before April 15, 2015, the Court, on its own motion, may dismiss the appeal, without further notice, or the respondents may move to dismiss the appeal, on three days notice.
